GOLF CART TERMS OF USE AGREEMENT
The act of tendering applicable golf cart fees is considered an opt-in by
you and the other members of your group to our Golf Cart Terms of Use
Agreement. You hereby understand and consent to the following terms:
Anyone who operates one of our golf carts MUST be at least 16 years of age,
and have a valid driver’s license
Golf carts must remain within golf course property at all times.
Golf carts must be operated in a safe manner at all times
Two-passenger golf carts must have no more than two passengers at any time,
and those passengers must be seated while the cart is in motion
It’s the operator’s responsibility to collect and remove their belongings
from the cart. Heritage Golf Links is not responsible for any items that
are left behind and unable to be recovered
The golf cart operator is responsible for paying for any and all damages
caused to the cart, or to the golf course by the cart, while the cart is
being rented by said operator. The rental period starts from when the
operator pays their golf fees, and ends when the cart is returned to the
pro shop.
GOLF CART WAIVER OF LIABILITY AGREEMENT
The act of tendering applicable golf fees is considered an opt-in by you
and the other members of your group to our Golf Cart Waiver of Liability
Agreement. You hereby understand and consent to the following terms:
I have no knowledge of any physical impairment that would affect my ability
to properly and safely operate a golf cart
I understand that there may be further rules and regulations that must be
followed. These rules and regulations may be posted or orally related to
the operator and the other members of his/her group. I agree to abide by
the rules and regulations, and failure to do so may result in my being
removed from the premises.
I recognize and acknowledge that there are certain known and unknown risks
of physical injury to persons utilizing a golf cart, including but not
limited to the following: golf cart rollover, collision with stationary
objects, horseplay, negligent driving, being struck by flying objects, and
falling out of golf carts. I voluntarily and fully choose to incur any and
all such risks and dangers on behalf of myself.
I hereby fully and forever waive, release and relinquish any and all
claims, demands and actions whatsoever that I may have or may accrue to me
against Heritage Golf Links and its employees arising from, or in
connection with the use of the golf cart.
I further agree to indemnify and hold harmless and defend Heritage Golf
Links from any and all claims and actions resulting from injuries, damages
and losses sustained by me or any passenger, and arising out of, connected
with, or in any way associated with the use of the golf cart, except to the
extent any liability arises out of any willful and wanton act or omission
of Heritage Golf Links.
